The petitioner is apprehending his arrest in connection with P.R. Case No.93/2018 registered for offences punishable under Sections 30(a), 32(1) and 39(1) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is about recovery of huge quantity of liquor from the truck and the petitioner is said to be owner of the Truck and transporter.

Submission of the learned counsel for the petitioner is that he has no knowledge about booking of the liquor to Bihar and as a matter of fact booking was made in some other pretext, as such he may not be held responsible for that, however, no paper has been produced by the learned counsel for

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders and pray for regular bail along with the documents showing his innocence that he has no knowledge about booking of the liquor to Bihar or booking has been made on some other pretext, the same shall be considered by the learned court below and considering the same and other materials available on the record, he will dispose of the prayer for bail of the petitioner, if possible on the same day. With the aforesaid direction, this application is disposed of.
