JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special (Excise) Case No. 614 of 2017 (S), arising out of Sour Bazar P.S. Case No. 599 of 2017 for the offence registered under Section 30 (a), 38 (1) and 41 (1) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case similar circumstance other co-accused namely Vishnu Deo Poddar has been granted bail vide order dated 19.2.2018 in Cr. Misc. No. 9220 of 2018 and co-accused Santosh Poddar @ Santosh Pauddar has been granted bail vide order dated 17.4.2018 in Cr. Misc. No. 21825 of 2018 by co-ordinate bench of this court.

Patna High Court Cr.Misc. No.37868 of 2018(2) dt.28-06-2018 2/2 Considering the aforesaid and on the ground of parity, let the petitioner, named above is directed to be released on bail on furnishing bail bond of Rs.10000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Saharsa, in connection with Sour Bazar P.S. Case No. 599 of 2017 (Special Excise Case No. 614 of 2017 (S).
