This is an application for bail in connection with Govindganj (Areraj) P.S. Case No. 270 of 2016 registered for the offences punishable under Sections 304B, 201 and 120B of the Indian Penal Code.
Allegation against the petitioner is of causing death to his wife.
Submission of learned counsel for the petitioner is that she was ill and during treatment she died, which will appear in the statement of witnesses in case diary and he is in custody since 28.6.2017.
Heard learned APP also, who has opposed the prayer for bail stating that some of the witnesses have supported the
Patna High Court Cr.Misc. No.43737 of 2017 (3) dt.18-10-2017 2/2 prosecution case.
Having heard both sides and in view of the allegation, I am not inclined to grant bail to the petitioner at this stage. However, once informant and his family members have been examined in this case, petitioner may renew his prayer for bail before the court below, which shall be considered on the basis of their evidence.
