Petitioner is in custody in connection with Darbhanga (Sitamarhi) Case No. 63 of 2018 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He has been made accused in this case only on suspicion. He further submits that nothing was recovered from conscious possession of the petitioner. He submits that 90 liters of Nepali wine was seized from the railway station which is a common place where everyone including the petitioner has access. Considering the fact that petitioner has no criminal antecedent and he is in custody since 25.4.2018 and as such he
