The petitioner, being the husband of the informant is languishing in custody since 10.12.2018 in a case registered for the offences punishable under Sections 323,341,313 and 498A of the I.P.C. and Sections 3 and 4 of Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demand and assault being made to the informant, as a result, her pregnancy got terminated.

It is submitted by learned counsel for the petitioner that the petitioner has been roped in the present case on baseless accusation and it is the informant who does not want to live with the petitioner. It is further submitted that earlier also, Complaint Case No. 143 of

Patna High Court CR. MISC. No.15736 of 2019(2) dt.14-03-2019 2/2 2014 was filed with accusation under Section 498A of the IPC wherein the petitioner has been acquitted.

Learned APP submits that the petitioner is husband of the informant and he is named in the FIR.

Considering the nature of accusation and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM I, Barh in connection with Bakhtiyarpur P.S. Case No.614 of 2018.
