The petitioner seeks regular bail in connection with Muffasil (Munger) P.s.Case No.37 of 2017, G.R.No.309 of 2017 registered for offences punishable under Sections376 and 114 of the Indian Penal Code and Section 3,4, 5 and 7 of the Information & Technology Act and Section 25(1-B)a/26(i)/35 of the Arms Act and Section 30(a) , 37(a)(b)(c)(d) of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is about supplying the girl for immoral trafficking.
Submission of the learned counsel for the petitioner is that only allegation against the petitioner is that one co-accused has asked the petitioner to come along with the girl and except that
Patna High Court Cr.Misc. No.47112 of 2017 (2) dt.12-10-2017 there is no allegation against him. He is in custody since 5.6.2017 and the petitioner has no criminal antecedent. Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of serious nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial of the petitioner and try to conclude it within a period of six months, and if not concluded, the petitioner shall renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
