The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 27 of the Arms Act and sections 307 and other sections of the IPC. As per the prosecution case, three unknown persons riding on a motorcycle, snatched cash Rs.3.05 lacs, three cheque books, ID Card and account opening form from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Only material that has come against this petitioner is that he was one of the conspirators. No incriminating material including the looted articles have been recovered from the conscious

Patna High Court CR. MISC. No.15966 of 2022(2) dt.16-05-2022 2/2 possession of the petitioner. Test Identification Parade has not been carried out till date. Petitioner claims clean antecedent and is in custody since 28.09.2021 and investigation in this case is complete.

Considering the aforesaid facts and circumstances of the case and the period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Begusarai in Birpur Police Station Case No. 78 of 2021.
