Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Earlier prayer for bail of the petitioner was rejected by this court taking note of this fact that looted mobile is said to have been recovered from his conscious possession but learned counsel appearing for the petitioner drew my attention towards photostat copy of the charge sheet annexed with supplementary affidavit and submitted that the aforesaid charge sheet goes to show that looted mobile was recovered from the possession of co-accused Shyam Kumar Rai who has already been granted privilege of bail by a coordinate bench of this court vide order dated 2.3.2015 passed in Cr. Misc. no. 8108/2015.

Considering the aforesaid facts and circumstances as well as

Patna High Court Cr.Misc. No.45700 of 2017 (4) dt.22-11-2017 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Darbhanga in Sessions trial no. 469/2016 arising out of Bishanpur P.S. Case no. 95/2013.
