The petitioner seeks bail in connection with Sessions Trial No. 509 of 2019, Sitamarhi P.S. Case No. 964 of 2015, dated 07.12.2015, instituted for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the F.I.R.

The wife has lodged a case about the killing of her husband at the hands of her step daughter and her husband. The aforesaid two persons are stated to have been granted bail. The name of the petitioner has transpired in the confession of an accused person in which he has stated that the petitioner was also involved in the killing of the deceased. Another person, who was named in the aforesaid confession, has also been granted bail by a Bench of this Court. The petitioner is stated to be in custody since 23.11.2019 and up-till-now, only charges have been framed. Considering the facts afore-stated, the petitioner abovenamed is directed to be released on bail on his furnishing bailbond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with

two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sitamarhi in connection Sessions Trial No. 509 of 2019 arising out of Sitamarhi P.S. Case No. 964 of 2015.

However, it is directed that the petitioner shall participated in the trial and his unauthorized absence from the trial proceedings on two occasions would render the bail granted to him liable to be cancelled.

The application stands allowed.
