JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Bhawanipur P. S. Case No. 130 of 2017 instituted for the offences under sections 302/34 of the Indian Penal Code.

It is alleged in the written report that the son-in-law of the informant, Raj Kumar Sah, who is husband of the deceased had developed love affairs with a girl and paid Rupees 20,000/- which was protested by the daughter of the informant and she gave pressure to her husband to take back the aforesaid amount, thereafter, her husband along with other co-accused assaulted her and killed her and after death also accused persons put poison in her mouth for showing the death as suicide.

Patna High Court Cr.Misc. No.35434 of 2017 (2) dt.01-08-2017 2/2 It has been submitted that the petitioner is devar of the deceased, who has falsely been implicated in this case with ulterior motive and he has clean antecedent.

In the facts and circumstance of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Purnea in connection with Bhawanipur P.S.Case No. 130 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
