Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.11.2017 in connection with Sahebganj P.S. Case No.335 of 2017 registered for the offence under Section 364/34 of the Indian Penal Code. Learned counsel for the petitioner submits that save and except the suspicion that the petitioner had grouse against the husband of the informant regarding non-payment of Rs.1,00,000/-, which the petitioner has lent to the deceased, there is no further material to implicate the petitioner in

Patna High Court Cr.Misc. No.36702 of 2018 (2) dt.06-07-2018 2/2 connection with the present case. As per the F.I.R. itself, it appears that the petitioner had informed the wife of the deceased that they had taken Nasta together and thereafter the deceased left with one Manoj Rai. It is further submitted that two other similarly situated co-accused, namely, Jai Lal Rai and Manoj Rai, have since been granted the privilege of bail in Cr.Misc. No.15267 of 2018, vide order dated 10.04.2018, and Cr.Misc. No.27433 of 2018, vide order dated 07.05.2018. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st (West), Muzaffarpur, in connection with Sahebganj P.S. Case No.335 of 2017.
