The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.
Allegation is that the four unknown persons on the point of pistol snatched motorcycle, cash and mobile of the informant.
The earlier bail application of the petitioner was rejected vide Annexure 3 to the present application. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.02.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not
Patna High Court CR. MISC. No.15279 of 2019(2) dt.22-04-2019 2/2 named in the F.I.R. His name has come on self confession made before the police. One mobile phone along with perse is alleged to have been recovered. The articles were not put on T.I.P. nor the petitioner has been put on T.I.P. Other co-accused has been granted bail vide Annexure 4 to the present application. The informant has already been examined during trial. He has refused to identify the petitioner. The deposition of the informant is Annexure 5 to the present application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sheohar in connection with Sessions Trial No.43 of 2018 arising out of Tariyani P.S. case No.7 of 2018.
