The petitioners apprehend their arrest in a case registered under Sections 447, 461, 379, 504, 506 and 34 of the IPC.
According to the FIR, the petitioners are alleged to have made demand of extortion money and on refusal, looted the shops of the informant party.
It has been submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners and
Patna High Court Cr.Misc. No.24370 of 2015 (2) dt.14-07-2015 2/2 that there is no recovery of any looted articles from the possession of the petitioners. Further, from perusal of the impugned order, it appears that certain witnesses have stated that there is no such shop of the informant as to when certain receipts have been filed on behalf of the informant stating that there is a shop of the informant as stated in the first information report. On behalf of the State, it has been submitted that the petitioners are named in the first information report.
Considering the aforesaid facts and circumstances, petitioners, named above, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara, Bhojpur in connection with Ara Town P.S.Case No.492 of 2014, subject to condition as laid down under section 438(2) of the Cr.P.C.
