The petitioners apprehend their arrest in connection with Pupri P.S. Case No. 592 of 2018, registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 38 and 41 of the Bihar Excise Act.
The accusation is of recovery of five bottles each containing 375 ml and one bottle containing 180 ml Indian made foreign liquor from the road side concealing in bamboo leaf near the Charki dam. On query, the local Choukidar and spy disclosed the name of petitioners and Kalicharan Singh having hand in concealing the aforesaid liquor in bamboo leaf.
Patna High Court CR. MISC. No.15567 of 2019(5) dt.26-07-2019 2/2 Learned counsel for the petitioners submits that the petitioners were not apprehended by the police at the spot and the seized liquors were recovered from the road side concealing in bamboo leaf near the Charki dam but mere on suspicion, the both petitioners have implicated in the present case. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Sitamarhi, in connection with Pupri P.S. Case No. 592 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
