The petitioners, three in number, apprehend their arrest in a case under Section 353 and other sections of the Indian Penal Code and Sections 3, 4 & 5 of the Essential Services Maintenance Act.

Allegation against the petitioners is that they blocked the road and were damaging public property. Even after 21⁄2 years of the kidnapping of the son of Lakhindra Paswan, the police was not taking any action and, that is why, the villagers made protest by blocking the road. It is submitted that similarly situated accused person has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 34350/2014.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.24939 of 2015 (2) dt.14-07-2015 2/2 petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Mithanpura P.S. Case No. 187/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
