JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 11-05-2016 After some argument, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present application with a liberty to file a fresh application for grant of anticipatory bail in connection with Nanpur P.S.Case No. 373 of 2015 pending in the court of learned Sub Divisional Judicial Magistrate, Pupari at Sitamarhi.

Permission is accorded.

The present application stands disposed of as withdrawn with the liberty aforesaid.

It is clarified that if a fresh application for grant of anticipatory bail is filed on behalf of the petitioner in connection with the aforesaid criminal case, the same shall be considered and decided on its own merits without being prejudiced by order dated 20.04.2016 passed in Cr.Misc.No. 13579 of 2016, which stood dismissed for want of prosecution.
