The petitioner seeks bail in connection with Purnahiya P.S. Case No. 85 of 2022 dated 13.05.2022 registered for the offence punishable under Sections 402, 406, 409/34 of the Indian Penal Code.

The prosecution case, in short, is that under the orders of the Block Education Officer, an F.I.R. has been lodged for recovery of an amount of Rs 3,89,500/-, which was required to be utilized for the purposes of some civil construction of a school, where the petitioner was at the relevant time. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

It is submitted that the petitioner was the then Secretary of the Education Committee of Middle School and Ram Ayodhya Singh was the then Headmaster of that school. In the year 201415 allotment came for the construction of three additional class rooms and after that the Drawing And Disbursing Officer Ram Ayodhya Singh took back the entire amount but the work was not completed on the complaint made by the petitioner and in a pretence Ram Ayodhya Singh took the signature of the petitioner on the clearance paper because the petitioner being a women could not understand the consequences. The petitioner has not taken back any amount for construction of additional class rooms.

Further it is submitted that the said Headmaster, namely, Ram Ayodhya Singh has been granted bail on 07.02.2023 vide Criminal Miscellaneous No. 61853 of 2022 by a Co-ordinate Bench of this Court. The petitioner is in custody since 08.01.2023, having no criminal antecedent and chargesheet has been submitted in the case. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with
