This application is for grant of regular bail in connection with Aungari P.S.Case No.22 of 2017 for the offences under Sections 363, 365, 120(B) and 34 of the Indian Penal Code. The petitioner is not named in the FIR. As per the FIR, the prosecution story is that minor girl of the informant was kidnapped with purpose to marry her somewhere and later on at the instance of the petitioner she has been recovered from the house of one Sanjay Singh and her statement was recorded under Section 164 Cr.P.C. The petitioner is in custody since 3.6.2017. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.45294 of 2017 (3) dt.11-10-2017 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage but once the charge is framed in this case, the learned court below will release the petitioner on bail in connection with Aungari P.S.Case No.22 of 2017 on the condition that he will co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure on his part to appear before the court below without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
With the aforesaid observation, this application is disposed of.
