JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Virendra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 18-07-2017 in Runnisaidpur P.S. Case No. 81 of 2016 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Section 47(A) of Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail, primarily on the ground that other two accused, having similar accusation, have been granted bail. The co-accused Ranjit Manjhi, who was apprehended at the spot, was granted bail on 16-06-2016, vide Cr. Misc. No. 21734 of 2016 (Annexure - 2), whereas, one another accused namely Umesh Rai was granted bail on 27-06-2016, vide Cr. Misc. No. 21341 of 2016 (Annexure - 3).
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.41917 of 2017(2) dt.15-09-2017 2/2 petitioner's case is exactly similar to the case of other two accused persons. He accepts that in the case, recovery of about 1100 liters of spirit was shown.
Considering the fact that other two accused persons, having similar accusation, have been granted bail, there is no reason to further detain the petitioner.
Accordingly, let the petitioner namely Chandan Rai @ Chandan @ Chandan Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.- II cum Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P.S.
