1. Let the defects, if any, pointed out by the office be removed within three weeks from the date of this order, failing which the matter be listed again under the appropriate heading for necessary action.

2. Heard learned counsel for the petitioner and the learned APP for the State.

3. Petitioner seeks regular bail in connection with Alamganj P.S. Case No. 906 of 2022 dated 20.11.2022 registered for the offences punishable under Sections 30(a)(b)(c) (d), 32, 33, 34 and 36 of Bihar Prohibition and Excise Act.

4. The main submissions advanced by learned counsel for the petitioner are that the instant matter relates to the recovery of 7.875 litres of country made foreign liquor and 20 litres of spirit and the same are stated to have been recovered

Patna High Court CR. MISC. No.18578 of 2023(2) dt.09-05-2023 2/2 from the house of this petitioner but the said house is in joint possession of the family members of the petitioner and against the petitioner, there is criminal antecedent of one case and he has been languishing in jail since 22.11.2022 and against him, the investigation has been completed in the present matter. Further submission is that all the family members of the petitioner have been made accused in this case.

5. Learned APP appearing for the State opposes the bail prayer of the petitioner.

6. Considering the above submissions and mainly the completion of the investigation against the petitioner and his custody period, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Alamganj P.S. Case No. 906 of 2022.
