The petitioners have prayed for bail in a case instituted for the offence under Sections 341, 342, 147, 148, 149, 447, 448, 452, 323, 324, 325, 307, 379, 427 and 302 of the Indian Penal Code.
As per allegation in the FIR, on 15.12.2022 when the informant and his son are giving goods to customers in the meantime, all FIR named accused persons including the petitioners came there and started to assault them and forcibly took away his son from his shop. Co-accused Nago Mandal and Shiv Kant Mandal assaulted his son with butt of rifle on back of his head as a result of his he died during treatment at PMCH, Patna. It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.16280 of 2023(3) dt.21-06-2023 2/2 that petitioners have been falsely implicated in this case. Specific allegation of assaulting to deceased is against coaccused Nago Mandal and Shiv Kant Mandal and not against the petitioner. General and omnibus allegations have been levelled against the petitioners. Both are only the members of the mob. There is case and counter case. Both the petitioners are languishing in judicial custody since 18.12.2022. The application for bail is opposed by learned APP for the State and learned counsel for the informant have opposed the prayer of bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Lakhisarai in connection with Chanan P.S. Case No. 180 of 2022.
