JUSTICE BIBEK CHAUDHURI ORAL ORDER 28-11-2024 The petitioner has approached the Constitutional Court for a direction upon the respondents to disburse her salary, which has fallen due since 2018, though she has been discharging her duty as Tamili Markaj (Shiksha Sevak) in Urdu Middle School Jogiya, Allouli, Khagaria.

2. There is no counter affidavit on record filed by the respondents.

3. It is needless to say that if the petitioner discharges her duty as Tamili Markaj (Shiksha Sevak) in Urdu Middle School Jogiya, Allouli, Khagaria, she is entitled to get her

Patna High Court CWJC No.5321 of 2020(5) dt.28-11-2024 2/2 salary.

4. In view of such circumstances, let a copy of this writ petition be sent to the Respondent No 3, District Education Officer, Khagaria, who will treat the same as representation filed by the petitioner and take decision within 60 days from the date of communication of this instant writ petition with this order as to whether petitioner is entitled to get salary since 2018 or not.

5. If she is entitled to get salary, the Respondent Nos. 3, 4 and 5 are directed to disburse the same within 60 days from the date of this order.

6. With the above direction, the instant writ petition is disposed of.
