The appellants seek regular bail in Shikarpur P.S. Case No.258 of 2017 for the offence under Section 147, 148, 149, 323, 307, 436, 435, 379, 504 of I.P.C., Section 3(i) (x)(xi) of SC & ST (Prevention of atrocities ) Act and Section 27 of the Arms Act. Allegation as per the F.I.R. against the appellants is of assaulting the informant.
Submission of the learned counsel for the appellants is that there is general and omnibus allegation against the appellants and co-accused has already been granted bail vide order dated 9.8.2017 passed in Cr.Misc.No.2306/17.
Patna High Court CR. APP (SJ) No.2219 of 2017 (2) dt.22-08-2017 2/2 Heard learned Special A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as state above, let the appellants, above named, be released on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Judge-cum-Special Judge, West Champaran, Bettia, in Shikarpur P.S. Case No.258 of 2017 subject to the conditions that one of the bailors must be local person having sufficient immovable properties within the jurisdiction of the court and they will cooperate in the trial and appears before the court on each and every day fixed in the case, failing which their bail bonds shall be cancelled.
