The petitioner apprehends her arrest in Sandesh P.S. Case No.162 of 2017 registered under Sections 420, 409, 120(B) of the Indian Penal Code.

The informant filed complaint case alleging therein that the Sarpanch did not pay the allowance to the punches for the year 2011-12 and 2012-13. The informant further alleged that Sarpanch, Baby Devi withdrew the entire amount in the name of her husband.

The learned counsel for the petitioner submits that petitioner is not named in the complaint petition as an accused. Her name appeared in the complaint petition as witness no.9. During the course of investigation, the name of the petitioner

Taking into consideration the fact that the petitioner is Upsarpanch and she did not withdrew any amount rather Sarpanch Baby Devi withdrew the amount, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IX, Bhojpur(Ara) in connection with Sandesh P.S. Case No.162 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
