JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioners are apprehending their arrest in connection with Chakand P.S. Case No. 68 of 2017, registered for offences punishable under Section 364/34 of the I.P.C. Allegation as per F.I.R. is that the husband of the informant was taken by Laxminiya Devi and thereafter Laxminiya Devi came back and she found that that the petitioner and other accused persons have locked her husband in a room. It has been submitted on behalf of the petitioners that except statement of Laxminiya Devi there is absolutely nothing adduced against the petitioners and there is delay of 15 days in lodging the F.I.R. It has been submitted that the said Laxminiya Devi has not been named in the F.I.R., whereas these petitioners

Patna High Court Cr.Misc. No.37280 of 2018 (3) dt.20-07-2018 2/2 have falsely been named in the F.I.R.

Heard learned A.P.P. also who opposes the prayer of bail. Having heard both sides, in view of the above facts and circumstances of this case, I am not inclined to grant privilege of anticipatory bail to the petitioners rather to surrender make prayer for regular bail which would be considered on merit.
