JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Bihar P.S. Case No. 01 of 2019 for the offenses under Sections 467, 468, 471, 419, 420 of the Indian Penal Code and Sections 25(1b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Referring to the prosecution case he submits that during the patrolling the police intercepted the petitioner and two others and on search country made pistol with two live cartridges were recovered from the possession of one Abhishek Narayan and not from the possession of the petitioner. The petitioner is in custody since 2.1.2019.
