Petitioner, already in custody, seeks bail in connection with Mansahi P.S. Case No.53 of 2016, registered under Sections 302, 201, 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that some of the witnesses have stated during their deposition that the deceased died due to drowning and another co-accused Dilip Sahni has been granted bail by a coordinate bench of this Court vide Cr. Misc. No.51935 of 2016 on 25.01.2017 and trial is not likely to be concluded in near future.
The learned Additional Public Prosecutor submits that the impugned order itself speaks that out of 11 witnesses, 9
Patna High Court Cr.Misc. No.51597 of 2017 (2) dt.01-11-2017 2 /2 witnesses have been examined and trial is likely to be concluded within four months.
Considering the said facts and circumstances, prayer for bail of the petitioner is rejected in connection with Mansahi P.S. Case No.53 of 2016, pending in the court of learned Sessions Judge, Katihar with an observation that if the trial is not concluded within four months, the petitioner may renew his prayer of bail.
