JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 The petitioner seeks bail in connection with Rosera P.S. Case No. 08 of 2018 instituted for the offences under Sections 379, 461, 411 of the Indian Penal Code. A burglary had taken place in the godown of the informant.
The petitioner has not been named in the F.I.R. His name transpired in the confession of the co-accused. From the house of the petitioner, seventeen pair of shoes and thirty one pieces of apparel were recovered.
The learned counsel for the petitioner has submitted that he is a small time businessman who purchases the aforesaid articles from the market and sells it to the purchasers by moving from door to door. There has not been
Patna High Court Cr.Misc. No.39672 of 2018 (2) dt.09-07-2018 2/2 any identification of the seized articles from his house to ascertain that those are the looted articles. The petitioner does not have any criminal antecedent and he is in custody since 01.02.2018.
Considering the aforestated facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, I, Rosera in connection with Rosera P.S. Case No. 08 of 2018.
