The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a), 36, 41(i) of Bihar Excise and Prohibition (Amendment) Act, 2018. There is recovery of 2160 litres of foreign liquor. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and the name of the petitioner transpired during the course of investigation and nothing has been recovered from the conscious possession of the petitioner.

Learned A.P.P. for the State has opposed the bail

Patna High Court CR. MISC. No.20157 of 2023(3) dt.24-06-2023 2/2 petition of the petitioner on the ground that petitioner has got one criminal antecedent of similar nature.

Considering the aforesaid facts and circumstances of the case and the fact that the petitioner is accused of similar nature of offence, I am not inclined to grant bail to the petitioner. Therefore, the prayer for bail of this petitioner is rejected.
