The petitioner seeks bail in Saraiya (Jaitpur OP) P.S. Case No. 730 of 2021, registered for the offence punishable punishable under Sections 272, 273, 328, 307, 302, 341, 120(B) of the Indian Penal Code and sections 30(a), 30(c) and 37(b) of the Bihar Prohibition and Excise Act, 2016.

Eleven named persons including this petitioner are said to have indulged in sale of spurious liquor which led to death of several persons.

It is submitted that no spurious liquor has been recovered either from the house of petitioner or from his conscious possession and only on suspicion petitioner has been made accused in this case. Spurious liquor has been recovered

Patna High Court CR. MISC. No.16738 of 2022(2) dt.20-05-2022 2/2 from the shop of co-accused. Petitioner is in custody since 02.11.2021 having no criminal antecedent, as stated in para 3 of the petition. Chargesheet has already been submitted. Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court No. II, Muzaffarpur in connection with Saraiya (Jaitpur OP) P.S. Case No. 730 of 2021.
