The petitioners are apprehending their arrest in connection with Chandan (Anandpur) P.S. Case No. 96 of 2015 for the offences instituted under Sections 304(B), 201 and 120(B)/34 of the Indian Penal Code.
As per prosecution case, it is a case of murder of informant's married daughter, namely, Bulbul Devi by the accused persons due to non-fulfilment of demand of dowry. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioner nos.1 and 2
Patna High Court Cr.Misc. No.20305 of 2016 (3) dt.27-06-2016 are the brother-in-law, petitioner no.3 is the Gotani, petitioner no.4 is the father-in-law and petitioner no.5 is the mother-in-law of the deceased. Petitioners are separate in mess and property from the husband of the deceased. From perusal of para-63 of the case diary, it is evident that the police has found the case to be false against the petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Chandan (Anandpur) P.S. Case No. 96 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Banka, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
