Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 376/511, 34 of the Indian Penal Code. It is alleged that petitioner caught hold the daughter of the informant and made an attempt to ravish her and when informant went to make protest then he was assaulted by the accused persons. It is alleged against the petitioner that this petitioner caused injuries with farsa to the informant and his daughter.
It is submitted by learned counsel for the petitioner that injuries have been found to be simple and there is counter version of the occurrence also. Moreover the informant has retracted from the initial version and filed a
Patna High Court Cr.Misc. No.28395 of 2015 (2) dt.27-07-2015 2/2 petition to that effect before learned Court below. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Hathua P.S. Case No. 51 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Gopalganj. Accordingly the application is disposed off.
