JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Complaint Case No. 41 of 2011 in which cognizance has been taken under Section 375 of the Indian Penal Code. It is submitted that in this case after completion of investigation the Police submitted final form finding the case to be not true which was accepted but on the basis of protest complaint cognizance has been taken resulting the petitioner is apprehending his arrest. It is further submitted that co-accused has been allowed pre-arrest bail by the court below itself vide ABP No. 408 of 2014. Learned APP submits that against the petitioner there is different allegation.

Patna High Court Cr.Misc. No.30110 of 2014 (2) dt.19-01-2015 As the police after investigation submitted final form and co-accused has been allowed pre-arrest bail by the court below itself, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar, J. M. Ist Class, Nawada in connection with Complaint Case No. 41 of 2011, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
