ANJANA MISHRA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State as well as the learned counsel appearing on behalf of the informant. The petitioners are apprehending their arrest in connection with Jokihat P.S. Case No.17 of 2016, G.R. No.160/16 for allegedly having committed the offences under Sections 341, 324, 307, 354B/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the main allegation is against one Sunil Kumar Tatma and not against the present petitioners. The injury report also indicates that the injury purported to have been caused by sharp-cutting
Patna High Court Cr.Misc. No.18771 of 2016 (3) dt.04-07-2016 2/2 weapon, which has been attributed to Sunil Kumar Tatma and not these petitioners. The case diary in the present case also reveals the similar injuries.
In view of the aforementioned facts and circumstances and that there is no criminal antecedents against the petitioners, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Araria, in connection with Jokihat P.S. Case No.17 of 2016, G.R. No.160/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
