The petitioner seeks regular bail in S.T. No. 322/2017 arising out of Noorsarai P.S. Case No. 284 of 2016 registered for the offence under Sections 302/34 of the I.P.C. and Section 27 of the Arms Act.
Earlier prayer for bail of the petitioner has been rejected on merit vide Annexure-1 to this petition.
Submission of the learned counsel for the petitioner is that other co-accused have been granted bail vide Annexure-5 Series to this petition.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.44780 of 2017 (2) dt.20-09-2017 2/2 circumstances, as stated above, and as earlier prayer for bail of the petitioner has been rejected, I am not going into the merit of the case hence, his prayer for bail is rejected. However, as charge has already been framed in this case, the trial court is directed to expedite the trial and conclude within a period of seven months if possible to conduct it on the regular basis. S.P., Nalanda, is directed to ensure the attendance of witnesses. With this observation this application is dismissed. Let a copy of order be communicated to the S.P.,Nalanda.
