The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30 (a) of the Bihar Excise (Prohibition) Amendment Act, 2018. It is a case of recovery of illicit liquor which was kept in the bush beside the field of Kamlesh Yadav. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that no incriminating article has been recovered from the conscious or constructive possession of the petitioner and the name of the petitioner came into light at the instance of co-villagers and he has not been apprehended at the spot. Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-I, Aurangabad (Bihar) in connection with Madanpur P.S. Case No. 367 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
