Patna High Court CWJC No.9123 of 2015(2) dt.26-02-2019 2/3 petitioner submits that from 21.07.2008, the petitioner has been deputed at Soil Test Laboratory, Khagaul. Since then, he has been discharging duties as Assistant Director. Petitioner's learned Senior Counsel submits that in spite of repeated representations for grant of the benefits attached to posting in the Soil Test Laboratory, the benefits, such as House Rent etc are not being paid to the petitioner. Petitioner has made repeated claims but the authorities are not taking any decision in the matter. The last representation for grant of such benefits, made before the Sone Command Area Development Agency (for brevity, SCADA) on 20.02.2015 is part of Annexure 3 series to the writ petition.

Since decision regarding admissibility of such benefits including House Rent has yet to be taken by the authorities themselves, no useful purpose would be served by keeping the writ petition pending. In view of the fact that the SCADA has since been dissolved, learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner would be making a fresh representation in respect of the said claim before respondent No 8.

Let the comprehensive representation be filed within four weeks from today.
