JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This application, for grant of anticipatory bail, arises out of Dawath P.S. Case No. 20/18, disclosing offences under Sections 392 of the Indian Penal Code.
Allegation as per F.I.R. is that while the informant was coming after withdrawing money of Rs. 49900/- from the Bank, two motorcycle borne miscreants came and snatched away the above amount from the informant on the point of pistol and people present there disclosed the name of petitioner as well as the co-accused disclosed the name of petitioner. Submission of learned counsel for the petitioner is that save and except the confessional statement of co-accused there is nothing against the petitioner and he has no criminal antecedent and has falsely been made accused in this case. Learned counsel for the State opposed the prayer for
Patna High Court CR. MISC. No.16211 of 2019(4) dt.14-05-2019 2/2 bail and submitted that the people present at the place of occurrence also disclosed the name of petitioner and the coaccused in his confessional statement has also named this petitioner.
Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may move the court below for regular bail, which will be disposed of by the court below on the merit of the case, without being prejudiced by this order.
