The petitioner seeks regular bail in connection with Katra PS case no. 165 of 2018 registered for the offence punishable under Section 395 of Indian Penal Code. The allegation is regarding the informant having been intercepted by the miscreants and his motorcycle was taken away by the said miscreants along with a Nokia mobile belonging to his brother-in-law who was also accompanying him.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has been remanded in the present case after he was arrested in Gaighat PS case no. 258 of 2018, on the basis of his confessional statement although neither any recovery has been

It is further submitted that apart from the aforesaid case, one other case is pending against the petitioner, in which he is on bail. The petitioner is said to be having a fair antecedent and is stated to be remanded in the present case on 11.01.2019 and since then he is languishing in custody.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 15th A.C.J.M. Muzaffarpur in connection with Katra PS case no. 165 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
