JUSTICE SATYAVRAT VERMA ORAL ORDER 21-10-2021 Heard Mr. Arun, learned Advocate for the petitioner and Mr. Chandra Bhushan Prasad, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Chhatapur P. S. Case No.58 of 2019, instituted for the offences under Sections 147, 149, 323, 379, 354B of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner has no criminal antecedent and has been falsely implicated in the present case for the reason that he objected the presence of Dinesh Sharma in the house of the informant. Further that the allegation is general and omnibus in nature. There is no injury report with regard to the allegation of assault. The learned A.P.P. opposes the bail application and submits that there is allegation of assault by lathi, danda, fists
Patna High Court CR. MISC. No.16386 of 2020(2) dt.21-10-2021 2/2 and slaps and that Rs.7,000/- was taken away along with two mobiles.
On this, the learned counsel for the petitioner submitted that the allegation from very perusal of the written report are general and omnibus in nature.
Considering the facts and circumstances of the case, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Supaul in connection with Chhatapur P. S. Case No.58 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
