JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,307,379 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner assaulted the informant with Farsa as a result he became unconscious, thereafter the petitioner snatched two mobiles of the informant. Co accused persons snatched golden chain of the informant worth Rs.52000/- whereas other accused persons assaulted with lathi though the accusation against petitioner is that he resorted to firing also. It is submitted by the learned counsel for the petitioner that the injury report reflects swelling and depressed wound, redness on the right eye and bruise on the right arm, hence

No.23722 of 2015 (2) dt.07-07-2015 2/2 swelling on the parietal region has been caused by hard and blunt substance whereas the petitioner is alleged to have assaulted with sharp cutting weapon like farsa. It is further submitted that 107 and 144 Cr.P.C. proceedings were initiated between the parties from before and title suit is also pending. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Bhargama P.S. Case No. 190 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
