Petitioner apprehends arrest in a case registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.
As per the prosecution case, the petitioner, with the help of his father, kidnapped the daughter of the informant and solemnized marriage with her.
It is submitted on behalf of the petitioner that according to the statement given by the victim girl under Section 164 Cr.P.C., she had left the house and gone with the petitioner at her own sweet will. It is further submitted that the marriage of the victim girl was solemnized with the petitioner on 31.10.2018 in the temple of Sitamarhi and both are living as husband and wife. Medical Board has assessed the age of the victim girl to be 18 to 19 years. It is stated by learned counsel
Patna High Court CR. MISC. No.16157 of 2020(4) dt.20-10-2020 2/2 for the petitioner in paragraph 3 of the bail petition that petitioner has got clean antecedent.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in Bikramganj Police Station Case No. 502 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
