JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 It is submitted that petitioner no.1 has been arrested, hence application with regard to petitioner no.1 has become infructuous.
Accordingly, the same is disposed of.
Petitioner nos. 2 to 4 is apprehending arrest in a case registered for the offences punishable under Sections 143, 147, 149, 323, 325, 379 and 506 of the Indian Penal Code and Section 3 (I) (r)(s) of the SC/ST (Prevention of Atrocities) Act. It is alleged that the accused persons intercepted the informant, abused by calling caste name, snatched `80,000/- and made assault.
It is submitted by learned counsel for the petitioners that the accusation of assault against the petitioners is omnibus and
Patna High Court Cr.Misc. No.23646 of 2015 (2) dt.07-07-2015 2/2 general.
It is submitted by learned counsel for the informant that 5-6 persons received injuries from the informant's side and the injury of one of the injured has been found to be grievous. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner nos. 2 to 4 if they surrender within a period of six weeks in connection with Chand P.S. Case No. 08 of 2015 pending in the court of learned CJM, Kaimur at Bhabua. Accordingly, the application is disposed of.
