====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 22-09-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and Section 27 of Arms Act.

No.16818 of 2022(2) dt.22-09-2022 2/3 The informant alleges that there was a case previously lodged against petitioner no. 1 as he had assaulted uncle and cousin of the informant on 29.10.2021 at 08:15 pm and was again using abusing language in an inebriated condition, further when the police came he fled away, it is next alleged that when police went back, the accused persons along with some unidentified criminals came at the place of occurrence and dragged the informant near Chandan Singh's shop and assaulted him, it is also alleged that victims fired ten round and when villagers gathered, the accused persons fled away. Learned counsel for the petitioner submits that petitioner no. 4 is a person with clean antecedent and petitioner no.

1, 2, 3, 5, 6 and 7 have antecedent of one case, it is next submitted that the allegation of assault is general and omnibus in nature and the allegation of firing is ornamental in nature as from perusal of Annexure-3 to the anticipatory bail application it would manifest that the injury suffered by the informant is simple in nature.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the

No.16818 of 2022(2) dt.22-09-2022 3/3 event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Madhepura P.S. Case No. 850 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) gauravkr/- U T
