2. The petitioner apprehends his arrest in a case registered for the offence under Section 7 of the Essential Commodities Act.

3. It is alleged that on physical verification of P.D.S. shop of petitioner, e-POS machine showed 17.63 quintals of wheat and 11.44 quintals of rice, against which, only 29.5 quintals of wheat was found in his shop and no rice was found and on inquiry, no satisfactory reply was given. Therefore, it revealed that petitioner sold the government food-grains in black-market.

4. Learned counsel for the petitioner submits that entire allegation is based on the data provided by e-POS machine, which was defective due to technical reason and

Moreover, during pendency of the case, the license of the petitioner has already been cancelled by the concerned authority. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - X, Gaya in connection with Fatehpur P.S. Case No. 460 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
