This application has been filed to restore Misc. Appeal No. 441 of 2003 which was dismissed for default on 29.01.2014. It is submitted that due to death of father, Sri Arun Kumar Singh, learned counsel could not attend the Court, as such, the case was dismissed for default. There is no laches on the part of the petitioner.
Considering the facts and circumstances, Misc. Appeal No. 441 of 2003 is restored to its original file. This petition is allowed.
