Perused the impugned order dated 05.02.2016 passed by learned Subordinate Judge-XII, Vaishali at Hajipur in Land Acquisition Case No.45 of 1990 whereby the court below rejected the application filed by the petitioner for referring Section 18 of the Land Acquisition Act, 1894 to the authority constituted under Land Acquisition and Rehabilitation and Re-settlement Act, 2013. From perusal of the impugned order, it appears that the court below has considered Section 24(2), Section 26 of the Act and also the judgment relied upon by the petitioner herein and then has passed the order.
In my opinion, the order passed by the court below is perfect, legal and within his jurisdiction which is according to law.
Patna High Court C.Misc. No.185 of 2016 (2) dt.10-08-2016 Therefore, I find no reason to interfere with the impugned order. Accordingly, this civil miscellaneous application is dismissed. (Mungeshwar Sahoo, J) Harish/- U
