The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304A, 120B, 420, 506 of the Indian Penal Code. The prosecution case is that the petitioners Niranjan Kumar Ghosh and Santosh Kumar Ghosh sold the land of the informant in favour of Brahmdeo Sah, who subsequently started making construction over it, the husband of the informant proceed to go to police station lodge complain, but due to shock he suffered heart attack and died.

It is submitted by the learned counsel for the petitioners that petitioners sold their share of land. There is

Patna High Court Cr.Misc. No.20095 of 2016 (2) dt.05-05-2016 nothing on record to suggest that petitioners sold the land of the informant. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur (Tiya O.P.) P.S. Case No. 33 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
