This is an application for bail in connection with Sessions Trial No. 246 of 2017, arising out of Nasriganj (Rajpur) P.S.Case No. 40 of 2017 registered for the offences punishable under Sections 364, 201, 120B and 302 of the Indian Penal Code. Allegation against the petitioner is of causing death of brother of informant.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and though prosecution alleged to have recovered blood stained dagger but the same has not been sent to FSL and he is in custody for six months. Heard learned APP also, who has opposed the prayer for bail on the ground that material has come during investigation that
Patna High Court Cr.Misc. No.48812 of 2017 (3) dt.17-11-2017 2/2 petitioner has love affairs with wife of deceased and further witness has supported the prosecution case that petitioner has taken dagger from his shop and there is ample circumstance against the petitioner.
Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.
