JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-07-2021 Heard Mr. Priyesh Kumar, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Piyar P.S. Case No. 41 of 2020 registered for the offence under Section 302 / 120 (B) / 34 of the I.P.C.
Petitioner renews his prayer for bail inasmuch as earlier the bail application of the petitioner was rejected in Cr. Misc. No. 24355 of 2020 granting liberty to the petitioner to move afresh for grant of regular bail after three months. The allegation as per the First Information Report is that petitioner assaulted his wife due to which she committed suicide.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.26205 of 2021(2) dt.07-07-2021 2/3 marriage had taken place about 10 years back and due to quarrel between husband and wife, the wife of the petitioner (i.e. deceased) committed suicide. Learned counsel next submits that petitioner is in custody since 3.3.2020, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail. Having heard learned counsel for the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 3.3.
2020, this is second attempt for bail on behalf of the petitioner, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur / court concerned in connection with Piyar P.S. Case No.
Patna High Court CR. MISC. No.26205 of 2021(2) dt.07-07-2021 3/3 on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
